Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and Tutro, Inc.(“Tutro”, “we”, “us”, “our”) governing your access to and use of the Tutro website at tutro.ai, the Tutro web application at app.tutro.ai, any associated mobile or desktop applications, and any related services, APIs, or content (collectively, the “Service”). By creating an account, using the Service, or checking a box indicating your acceptance of these Terms, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old to create a Tutro account in your own name. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed these Terms and agreed to them on your behalf. Parents or legal guardians may create “learner profiles” or issue magic-link sessions for children under 13 from their own account, in which case the parent or guardian remains fully responsible for the child’s use of the Service and for supervising that use.
You are responsible for keeping your login credentials secret and for all activity under your account. Notify us immediately at security@tutro.ai if you suspect unauthorized access.
2. AI-generated content — important disclaimer
The Service uses third-party artificial intelligence models (including models operated by Anthropic, Google, OpenAI, and ElevenLabs) to generate lesson plans, diagrams, narration, quiz questions, and voice-tutor conversations. All such content is generated programmatically and is provided “AS IS” without any representation or warranty as to accuracy, completeness, factual correctness, reliability, currency, suitability for any particular purpose, non-infringement, or freedom from errors, omissions, or bias.
AI systems can and do produce output that is incorrect, out of date, misleading, fabricated (commonly called “hallucinated”), incomplete, or contextually wrong — even when presented with apparent authority. By using the Service you agree that:
- You are solely responsible for independently verifying any fact, calculation, quote, citation, formula, date, medical or legal statement, safety instruction, or other piece of information produced by the Service before relying on it.
- Tutro content is provided for educational and informational use only. It is not professional advice of any kind (legal, medical, financial, psychological, engineering, accounting, nutritional, or other) and must not be treated as such.
- You will not rely on the Service for any decision with safety-of-life, financial, legal, medical, or high-stakes academic or professional consequences without independent corroboration from qualified sources.
- Any citations, sources, URLs, study references, or bibliographic entries shown in a lesson are AI-generated and may be inaccurate or fictitious. You are expected to check every source before citing it.
- Quizzes are auto-graded by AI or simple string comparison and may mark correct answers wrong or vice versa. Results are not authoritative academic grades.
- Tutro does not guarantee uninterrupted availability, a particular credit cost, a particular generation time, or that a given prompt will produce a usable lesson.
You acknowledge that the quality and accuracy of AI-generated output depends heavily on the prompts, files, and context you provide, and that your use of the Service is at your own risk.
3. Your content and license to Tutro
“Your Content” means anything you upload or submit: text prompts, photos, PDFs, slide decks, audio, voice recordings, feedback, and any lessons or quizzes you author via the Service. You retain ownership of Your Content. You grant Tutro a worldwide, royalty-free, non-exclusive license to host, store, transmit, reproduce, modify, create derivative works of, display, and otherwise process Your Content solely to operate, secure, maintain, and improve the Service for you — and, only where you explicitly opt in (for example, by toggling “Share with community”), to display it publicly on our community feed.
You represent that Your Content does not and will not violate any third-party intellectual-property, privacy, publicity, or other right, and that you have all permissions necessary to upload it.
Tutro-generated output (diagrams, narration, lesson plans) is produced by third-party AI models under their respective terms of use. To the extent Tutro holds any rights in that output, Tutro grants you a non-exclusive, worldwide license to use it for your own personal, educational, or internal business purposes. You may not resell, sublicense, or redistribute Tutro-generated content as a stand-alone product.
4. Acceptable use
You will not, and will not permit any user under your account to:
- Upload or generate content that infringes another party’s intellectual-property, privacy, publicity, or contractual rights.
- Upload or generate content that is unlawful, defamatory, harassing, threatening, hateful, sexual in the context of a minor, or that promotes self-harm, violence, or illegal activity.
- Impersonate or misrepresent any person or attempt to generate content targeting a real person without their consent.
- Reverse engineer, decompile, or scrape the Service, circumvent rate limits, or use automated tools to extract content beyond what the Service’s UI allows.
- Use the Service to train, fine-tune, or benchmark a competing AI model or product.
- Interfere with the Service’s security, overload our infrastructure, or deliver malware.
We may suspend or terminate any account that violates this section, with or without notice, and may remove content from the community feed at our sole discretion.
5. Credits, billing, and subscriptions
Most activities in the Service consume “credits.” Free-tier accounts receive a starter pool and a monthly refill; paid plans receive a larger monthly refill. Unused credits expire at the end of each billing period and do not carry over unless your plan explicitly says otherwise. Top-up credits you purchase carry over until used or until your account is closed.
Paid subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled before renewal. You can cancel at any time from Settings → Billing; your plan remains active through the end of the current period and then reverts to Free. Except where required by applicable law (including the Ontario Consumer Protection Act, 2002), fees already paid are non-refundable.
Pricing and features may change. Material changes to pricing take effect at your next renewal; we will give you written notice at least 14 days in advance and you may cancel before the new price applies.
6. Community sharing
If you toggle “Share with community” when creating a lesson, you grant Tutro and every Tutro user a non-exclusive, worldwide, royalty-free license to view, copy into their own library, and learn from that lesson. You can unshare at any time from the lesson page; Tutro may additionally remove community lessons that violate Section 4 or that we determine, in good faith, to be inappropriate for our learning community.
7. Third-party services
The Service integrates with third-party providers (Supabase, Anthropic, Google, OpenAI, ElevenLabs, Resend, Stripe, Vercel, and others). Those providers operate under their own terms and privacy policies. Tutro is not responsible for the acts or omissions of third-party providers, and a third-party outage may disrupt the Service.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUTRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. TUTRO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TUTRO, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR EDUCATIONAL OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE, EVEN IF TUTRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TUTRO’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TUTRO IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) CAD $100.
Nothing in these Terms limits any rights or remedies you have under applicable consumer-protection law that cannot lawfully be waived or excluded.
10. Indemnification
You agree to defend, indemnify, and hold harmless Tutro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with (a) Your Content, (b) your use of the Service in violation of these Terms, or (c) your violation of any applicable law or any third-party right.
11. Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your account if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Service. Sections 2, 3 (as to license grants that survive), 4 (last paragraph), 7, 8, 9, 10, 12, 13, and 14 survive termination.
12. Governing law and dispute resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts located in Toronto, Ontario have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts. The UN Convention on Contracts for the International Sale of Goods does not apply.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will give you at least 14 days’ notice by email or through the Service before they take effect, and we will update the “Last updated” date above and bump the version. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may close your account.
14. Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and Tutro regarding the Service and supersede any prior agreement. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor.
